This statement explains in plain language which personal data we process, why we do so, how long we keep it and what you can ask us about it. This is a translation; the Dutch version is authoritative.

  1. Who is responsible

Customswise.online is the controller of the personal data processed through this website, by email and in the course of an assignment. Customswise.online is a trading name of Mischa van de Werken, established at Diedenweg 16B, 6717 KT Ede, the Netherlands, and registered with the Chamber of Commerce under number 84621788.

You can ask questions about this statement or about your data at representation@customswise.online. We reply within one month.

This statement is written for business clients and their contact persons. Our services are not aimed at consumers.

  2. What personal data we process

When you use the contact form or email us, we process the details you provide yourself:

    • your name and email address
    • your company name and job title, if you provide them
    • the subject and content of your message
    • the attachments you send with your message

For an assignment we also process data of the client and of the persons and companies involved in the shipment or the declaration:

    • names, addresses and contact details of senders, consignees, carriers and intermediaries
    • EORI numbers, permit numbers and other registrations
    • invoices, packing lists, transport documents, certificates and other trade documents
    • details of the goods, such as type, quantity, weight, value and origin
    • invoice and payment details needed for invoicing and credit control

We do not process special categories of personal data, such as data on health or religion, unless you send such data yourself in a document and it is relevant to the assignment.

The form on this website does not store anything in a database. Your message is sent to us by email.

When you visit the website, our hosting provider processes technical data, such as your IP address in a log file, to deliver and secure the website.

  3. Why we use data and on what legal basis

We use personal data only for the purposes below. Each purpose states the legal basis under Article 6(1) of the General Data Protection Regulation (GDPR).

    • Answering your question and giving a first assessment: legitimate interest (Article 6(1)(f) GDPR). That interest is our ability to respond to a business enquiry.
    • Issuing a quote and preparing an assignment: steps taken at your request before entering into a contract (Article 6(1)(b) GDPR).
    • Carrying out an assignment, including customs declarations, origin documents, legalisations and consultancy: performance of the contract (Article 6(1)(b) GDPR).
    • Meeting legal obligations, such as the retention of customs documents and the tax retention duty: legal obligation (Article 6(1)(c) GDPR).
    • Invoicing, credit control and handling a dispute: performance of the contract and legal obligation (Article 6(1)(b) and (c) GDPR).
    • Securing the website and our email and preventing misuse: legitimate interest (Article 6(1)(f) GDPR). That interest is the security of our systems and of your data.

We do not use your data for advertising, profiling or automated decision making.

Where we obtain data from you directly, we inform you through this statement (Article 13 GDPR). Where we obtain data from someone else, for example from the client or from a trade document, we inform you at the first contact or at the latest within one month (Article 14 GDPR).

  4. How long we keep data

Messages that do not lead to an assignment are kept for no more than twelve months after the last contact. We then delete them.

Assignment files and the customs documentation in them are kept for at least three years under Article 51 of the Union Customs Code and usually for seven years, because the tax retention duty requires it.

Invoices and the financial administration are kept for seven years.

Data subject to a longer statutory retention duty, or needed for ongoing proceedings, is kept for as long as that duty or those proceedings last. We then delete it.

  5. Who we share data with

We do not sell your data and we do not share it for commercial purposes.

We share data with parties needed to provide the website and the service. Where required, we conclude a data processing agreement with them. These parties are:

    • Vercel, for hosting this website
    • Resend, for sending the email submitted through the form
    • Strato (InterNetX, Germany), for our email account
    • our accounting package, for invoicing and administration

We provide data to customs and to other public authorities where a declaration or a legal obligation requires it.

We also provide data where a court or a supervisory authority requires it, or where the law obliges us to do so.

  6. Transfers outside the EEA

Vercel and Resend may process personal data in the United States. Such a transfer is permitted under the EU-US Data Privacy Framework, where the party concerned is certified under it, or otherwise under the standard contractual clauses of the European Commission.

For any transfer we ensure appropriate safeguards for your data.

  7. Cookies and technical operation

This website does not set cookies for statistics, advertising or tracking. There are no analytics services and no advertising pixels.

Only technically necessary cookies and similar techniques are used, where needed to run and secure the website. Under Article 11.7a of the Dutch Telecommunications Act, no consent is required for these techniques.

The fonts on this website are served by our own hosting and are not loaded from an external service.

  8. Security

We take appropriate technical and organisational measures to protect your data. These include an encrypted connection (HTTPS), access restrictions on our systems and a limited number of people who work with the data.

The form does not store anything in a database. The message is sent to us by email.

If a data breach occurs that may affect you, we inform you and the Dutch Data Protection Authority as the GDPR requires.

  9. Your rights

You have the right to access the data we process about you, to have it corrected and to have it erased.

You may also ask us to restrict processing, object to processing based on a legitimate interest, and ask for the transfer of your data.

Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect processing that already took place.

Send your request to representation@customswise.online. We respond within one month. For a complex request we may extend that period by two months; we will tell you within the first month.

To prevent us from giving data to the wrong person, we ask for additional information to verify your identity.

  10. No automated decision making, no children

We do not take decisions with legal consequences for you that are based solely on automated processing, and we do not profile you.

Our website and services are intended for businesses. We do not knowingly collect data of persons under eighteen. If we encounter such data, we delete it.

  11. Complaints

If you are not satisfied with how we handle your data, please tell us first at representation@customswise.online. We will look for a solution with you.

You always have the right to lodge a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens, at autoriteitpersoonsgegevens.nl.
